These Terms of Use (“Terms of Use”, “Terms of Service”, “Terms and Conditions, "Terms") in conjunction with our Privacy & Cookie policy , Payment, Refund and Cancellation Policy and Shipping and Delivery Policy , are the entire binding legal contract between you and “Passion Pro Media” (collectively ““Passion Pro Media”, "PostInto”, “we”, “our”, “us”, “Site”, “Website”, “Web App”, “Mobile App”, “Portal”, “Service” or “Platform”). We reserve the right to remove, modify, change or amend this Website and any service or material provided on or through PostInto (such as our data storage, processing & sharing platforms, referred to as PostInto), in our sole discretion and without notice. We will not be liable if for any reason all or any part of PostInto is unavailable at any time or for any period. From time to time, we may restrict access to some parts of, or the entire PostInto, to visitors and users, including registered users of PostInto.

THE TERM “YOU” REFERS TO THE INDIVIDUAL OR LEGAL ENTITY, AS APPLICABLE, IDENTIFIED AS THE USER WHEN YOU BROWSE, SIGN-UP OR SIGN-IN ON PostInto.
What is PostInto?
PostInto is a set of internet based services provided through "Websites", "Portals", "Web Apps" ( Apps is short form for Applications ), "Mobile/Smartphone Apps" and other electronic devices, for buying & selling products and services, posting and sharing digital content - blogs, slideshows, profiles and pages, reels, stories, articles, promos, ads and more, completely for free as well as using paid premium subscriptions that may be added in future.
PostInto is owned, developed and operated by "Passion Pro Media" - a multi-media business registered in India ( GSTIN: 27AKPPA5253J1ZZ ). It is the data controller for it's own as well as User-Provided internet based online digital content and personal data collected through PostInto.
Who can use PostInto?
In order to use PostInto, you must be at least 13 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use PostInto if doing so is prohibited in your country or under any local laws or regulations applicable to you.
PostInto and Online Conduct
Portions of PostInto may allow visitors and users to communicate or share information with PostInto or others. You may use PostInto only for lawful purposes and in accordance with these Terms of Use. When using PostInto, you understand and agree that:

In addition to any remedies that PostInto may have at law or in equity, if PostInto determines, in its sole discretion, that you have violated or are likely to violate the foregoing prohibitions, PostInto may take any action it deems necessary to cure or prevent the violation, including without limitation, the immediate removal of the related materials from PostInto. PostInto will fully cooperate with any law enforcement authorities or court order or subpoena requesting or directing PostInto to disclose the identity of anyone posting such materials.
PostInto is legally bound to follow the local laws of Government of India, including latest Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, including a provision for an FCU to flag “fake, false or misleading online content related to the government".
As such, any content voilating the above mentioned laws and rules is prohibited on PostInto and would be taken down without any prior notice to the content owner/publisher, once such violation is brough to our notice.
You may create an online user profile consisting of a user-id, email, phone number and other information that you provide. It is a condition of your use of PostInto that all the information you provide on it is correct, current and complete. Any personal information you provide will be subject to PostInto’s Privacy & Cookie policy , and you consent to all actions PostInto takes with respect to your information consistent with PostInto's Privacy and Cookie Policy.
You understand and agree that you are solely responsible for maintaining the privacy and security of your sign-in credentials, and for any activity associated with your PostInto user account and profile. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password/PIN/OTP or other personal information. In the event that your sign-in credentials are compromised or you are aware of any unauthorized activity being conducted with your user credentials, you agree to immediately notify PostInto.
Creating or maintaining any link from another website to any page on PostInto, except for those shared using sharable links made available on PostInto, without our prior written permission is prohibited. Running or displaying this Site or any information or material displayed on this Site/Service/Platform in frames/iframes or through similar means on another website/platform without PostInto's prior written permission is prohibited.
The inclusion of any content, products or services on PostInto at a particular time does not imply or warrant that these content, products or services will be available for use/purchase at any time.
Publicly visible user profile and other published content
Given the nature of this website and services it offers, every registered user has a public profile that is publicly visible to site visitors, and that their public activity (such as their posts, comments, uploaded content files etc) will be visible to other visitors of PostInto.

Any User-Provided Content you provide to PostInto will be considered non-confidential and non-proprietary. You grant to PostInto a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, and distribute any User-Provided Content provided through PostInto for any or all commercial or non-commercial purposes, and acknowledge and warrant that you have the right and authority to provide such license to PostInto. You understand and acknowledge that you are responsible for any User-Provided Content you submit or contribute, and you, not PostInto, have full responsibility for such content, including its legality, reliability, accuracy and appropriateness. PostInto is not responsible, or liable to any third party, for the content or accuracy of any User-Provided Content posted by you or any other user of PostInto. PostInto does not claim any copyrights or ownership of any User-Provided content, except for those owned by us as mentioned above.
You recognize and agree that by uploading/posting any content ( including, but not limited to designs, images, animations, html/pdf documents, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works, links to externally hosted content ), through any means to PostInto, you confirm that you own all the relevant rights or possess the appropriate license/written consent from content owner/rights holder to upload/transfer/send the content. You agree and consent that the uploaded/transferred/linked/published content may be publicly displayed on PostInto.
Right to suspend or cancel user account
We may temporarily or permanently terminate or suspend your access to PostInto, without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable local laws or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.
Exclusion of Warranties for your use of PostInto
You understand that PostInto cannot and does not guarantee or warrant that files/content available for downloading from the internet or through PostInto will be free of viruses, malware or other destructive codes. You are responsible for implementing sufficient procedures and checkpoints to satisfy your requirements for anti-virus/anti-malware protection and accuracy of data input and output, and for maintaining a means external to PostInto for any reconstruction or recovery of any lost data. PostInto WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, MALWARES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, DEVICES, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF PostInto OR ANY SERVICES OR ITEMS OBTAINED THROUGH PostInto OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY SITE/SERVICES/PLATFORMS LINKED TO IT.
PostInto DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW. THE INFORMATION PRESENTED ON OR THROUGH PostInto IS MADE AVAILABLE SOLELY FOR GENERAL INFORMATION PURPOSES. USE OF PostInto IS AT YOUR SOLE RISK. PostInto ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FURTHER, PostInto DOES NOT WARRANT AND MAKES NO REPRESENTATIONS THAT PostInto (OR ANY PORTION THEREOF) WILL MEET YOUR NEEDS OR EXPECTATIONS; WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERROR; OR WILL PROVIDE INFORMATION THAT IS CURRENT, ACCURATE, OR SHOULD BE RELIED UPON. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAWS.
Without limiting the foregoing, any warranties, representations, indemnities or limitations of liabilities related to PostInto are provided in this Terms of Use and Acceptable Use Policy.
Indemnification
You agree to indemnify and hold “Passion Pro Media” and PostInto harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of PostInto.
Limitation of liability
To the maximum extent permitted by applicable laws, in no event shall “Passion Pro Media” and PostInto, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, PostInto.
To the maximum extent permitted by applicable laws, “Passion Pro Media” and PostInto assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of PostInto; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Right to change and modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of PostInto after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) PostInto .

You agree to receive from time to time newsletters, promotional messages and materials from us, by mail, email, notifications, messages or any other contact form you may provide us with (including your phone number for calls or text messages or push notifications). If you don't want to receive such promotional materials or notices – please disable them in "Settings" page of your account at any time.
Preference of law and dispute resolution
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws in India, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Mumbai, India.
Force Majeure
"Passion Pro Media" will not be considered responsible if there is a breach of its satisfaction guarantee policy or default under any terms of service, and shall not be liable to the Client for any cessation, interruption, or delay in the performance of its obligations by reason of earthquake, flood, fire, storm, lightning, drought, landslide, hurricane, cyclone, typhoon, tornado, natural disaster, act of God or the public enemy, epidemic, famine or plague, action of a court or public authority, change in law, explosion, war, terrorism, armed conflict, labour strike, lockout, boycott or similar event beyond our reasonable control, whether foreseen or unforeseen (each a “Force Majeure Event”).
